Orders of Protection

As soon as a person is arrested for domestic violence, the court will issue a mandatory protection order, sometimes called an order of protection. This protective order will remain in place until your sentence is complete, or until you have been cleared or dismissed of the charges. If you are ultimately found guilty, the judge can choose to modify the terms of the order before signing it into effect.

In general, under the terms of an order of protection, you will be ordered to:

  • Not harass, molest, intimidate, retaliate against, or tamper with any of the victims
  • Remain out of your home (if you share it with the victim), out of the victim’s home, the victim’s work, or any other place the victim may be. You must also remain at least 100 yards away from the victim at all times. If you and your spouse decide to reunite, you must first obtain court permission before making contact.
  • Refrain from communicating directly or indirectly with the victim. In cases involving children, you will only be able to see and communicate with them at court-approved places, times, and by proscribed methods.
  • If drugs or alcohol was an element of your case, you will be prohibited from possessing or consuming any drugs or alcoholic substances until your sentence is complete. You will also likely be required to attend substance abuse treatment.
  • Not possess or control a firearm or some other weapon
  • Wear an ankle monitoring bracelet

Order of Protection Violations

If the court has issued a protection order, you must abide by all of the terms set forth in the order or risk additional penalties. Any violation of the order will result in your arrest and possible jail time. In addition, you may also lose your right to probation, or your probation may be extended. Additional fines are also likely to apply.
